Personal loan from SBI through Zero balance A/c

The salary of the West Bengal Govt employees is being disbursed through bank now. The concerned bank (where the employee opened zero balance account) is also offering Personal loan to the employees subject to submission of an undertaking from the DDO of the employee's office certifying that the EMI may be deducted from the salary and in case of his death or termination of service for any other reason the office will pay the remaining part of the loan from gratuity, GPF etc of the employee directly to the employee's account.
But some DDOs denies to issue this certificate in terms of G.O. No. 3368-F, dt. 2001.
PLEASE REPLY HOW CAN THE EMPLOYEES OF GOVT OF WB AVAIL THIS PERSONAL LOAN OFFERED BY THE BANKS?

Just obtain a copy of the govt order and show the D.D.O. He must abide by the G.O.

In the order 3368-F it was clearly said that a Govt employee can avail personal loan in some grounds like daughter's marriage, children's education, family tour etc without prior permission from employee's office. But it was also stated that Government will take no responsibility for such loans. The order was issued 10 years ago. But now, when an employee is drawing his salary through a bank and the same bank is offering him a loan subject to a declaration from the DDO of the office that the Govt will pay the remaining amount of the loan from the concerned employee's gratuity, GPF etc in case of his death and suspension, should not the previous order be modified? I just want to know, is our Govt taking any measure so that both the bank and the employee gets benefit of e-banking system.

As per the said order, "It is hereby specifically stated that the Government will not be a guarantor in favour of a Government employees for the purpose of obtaining such loan nor it will take any responsibility for recovery of the said loan and interest theron."
Now, it is the Bank's Personal Loan Scheme on which the remaining part is dependent. The loan scheme should accordingly be modified after the implementation of ePS Scheme. So, in my opinion Bank may allow loan without that particular declaration by DDO. Many Banks have already modified the 'Employer's Declaration' part in their loan scheme. I have personal experience with UCO Bank which do not want this type of declaration by the employer concerned.

Thank you very much for your reply. We will request the SBI to modify their "Employees' Declaration" proforma. If possible, Govt. of West Bengal may also be requested to issue proper guideline / Orders so that all of their employees get equal facilities from all the nationalized Bank.

Memo. 3368-F dt. 26-3.2001 (copy enclosed) which will speak for itself and to request you to communicate all Branches under your control in this State the decision of the Government that the State Government Will not be a guarantor in favour of a Government employee for the purpose of obtaining loan of any kind from any Bank nor it will take any responsibility for recovery of the loan obtained by a Government employee from the Banks and interest thereon.

MEMORANDUM

Modus operandi as decided by this State Government and the SBI authority in respect of cases where a loanee State Government employee is transferred to a new station is as follows :

‘‘In the event of transfer of the loanee employee, the bank-branch after receipt of the proceeds of EMI of the concerned employee from the DDO of the new office to which the employee is presently attached on his transfer will send the amount of EMI by the internal mechanism of the bank of their branch from where the employee has originally taken his housing loan and where record is maintained thereunder. The original branch on receipt of the said EMI will immediately credit the amount to' the Home Loan Account of the concerned employee.

At the same time, DDOs should invariably mention the Home Loan Account number together with other particulars in the concerned employee's Last Pay Certificate. They may also keep the SBI branch apprised of the employee’s transfer to the new station. This will enable the two branches (both transferor and transferee) to arrange for smooth transfer / acceptance and credit of the EMI in the loanee employee’s Home Loan Account.”

This may be circulated to all DDOs for immediate necessary action in continuation of this Department Memo No. 90-F.B. dated 13.01.2005.

Same problems arises in case of para teachers. They are getting there salary through the zero balance account. But the sectretaries are not their DDOs. Therefore they are not ready to sign their form. Therefore they are not getting personal loans. Is there any way?

Please reply my above said topic. Because, one of our para teachers want to take loan from CBI. The bank wants permission from secretary. But he is not agree to do so. Is there any other way? The para-teachers are agitated. As an T.R. I am confused. Because, an an M.C. member I am agree with the opinion of the secretary. Again as A.T., I like to talk for the para-teachers. Please say something.

Authority may certify about para teacher's employment, pay etc. But how can they be a guarantor?

I think, the Bank would give proper solution to such problem. Because, there are rules / provisions for personal loan for salary account holder, which I exactly can not remember, but I guess, 3 months salary, can easily be sanctioned by the Bank authority. However, higher amount may also be taken subject to fulfilment of other criteria.
