I am citing a judgement for the benefits of the Hon'ble members of this forum. It says that "not making of representation is no bar for claiming promotion subsequently". In Punjab-Haryana High Court Vidya Prakash vs The State Of Punjab And Others IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH (C.W.P. No.421 of 1993 Decided on: 30.09.2008) the Hon'ble Court held that: "The only plea raised is that the petitioner did not make any representation when his juniors were promoted in the year 1972, 1973, 1979 and 1987. It is established on record that petitioner was not considered for promotion even when his juniors were promoted from time to time. Petitioner is matriculate. One Fateh Singh, who is matriculate and junior from the petitioner was promoted on 09.01.1985. Some of the juniors who are matriculates were promoted w.e.f. 1979. All other promotees were graduates. Therefore, there is no valid reasons to deny promotion to the petitioner when his juniors were promoted".
