The order has been issued by the department in the name of Governor. More over, it relates to a particular department for the cases in which the employee is facing criminal charges. It means it is not applicable on those employees against whom D.P has been ordered for internal departmental delinquencies.So, there is a partial relief from suspension for those against whom there is a criminal case. The question is that whether this order,as it is by the order of the Governor, has any force of law for the employees of any other department. I may please be informed whether any department like Finance or Home etc. has to be approached afresh for passing a similar order for its positive affect?
I have written to the Chief Secretary Shri Samar Ghosh by name with a copy of the order to make it enforceable in all the departments of the Government as if not done then it will be an arbitrary order hitting the spirit of Article 14.To know the progress I will file an RTI acpplication also after a fortnight. Let us see what he does with my petition.
It is almost about 5 months. No response from Shri Samar Ghosh Chief Secretary since retired. How the Ma,mati,Manush Government would work with such dullness of the Chief Secretary of the State? It speaks of the governance and the period through which we are passing. Some times frustration creeps in me and all the procedures look like one act drama. How the people will survive with such atrocious attitude of the office bearers of the government?
I am an assitant teacher of elite co-ed(H.S) school affiliated by w.b.b.s.e and w.b.c.h.s.e,
which is control by MC not by any owner.
They have recruited one person as principal age above 60 yrs. and also who are ex teacher of some icse affiliated school with very bad reputation.
whenever he think, he make any new rule without MC resolution.
For example,some days before he made one notice that .if CL taken without taken permission before 48 hours then salary should be deducted.
after some days he made another notice that no one can take any CL in august without any information.
from last 1 year some MC member are using the school as,they are owner of the institution.
when i submit one letter they have suspend me without prior permission from DI.
And also the suspension letter is signed by secretary not president.
Everytime some gurdian representive present in school premises as well as they are following teachers class activities.
My father is stared doing TMC party when that party stared their journey as now he is passed away,so as a son i also morally support TMC party from my heart.when i have entered in the principal office on 28/07/2017, mr. saugata ghosh and mr. achintya kumar sengupta after some argument say "get out from the school premises"in front of principal and secretary and after that they also say that they are TMC member ,Then who am i?Is the gurdian representative can have the right to behave this type with a teacher? please see the photo to see what is going on in our school............
now they have suspend me from my duty without DI approval.
As far as my understanding is concerned, if any suspension is imposed owing to the extra-official matters then the same should be treated as per the instant Memo. This is not a case where case to case merit arising out of an extra-official case should be judged explicitly. Logic is very simple.... Office is bearing the subsistence allowance without any service from the Suspended employee so the office administration/Govt should only be considered anything related to its office/official duties etc. If the suspension is ordered by the quasi judicial Departmental Proceeding Cell for violating the provisions of the conduct regulations or the regulations of similar kind which are connected to Criminal Proceedings under IPC especially in the cases where the employee may be appealed if preferred but remotely connected to discharging of Official duties, the employee should be allowed to join until the final verdict or the date of effect/commencement of the final verdict. That's all.
@subhasish mukherjee...I couldn't make out the problem properly as the post is not supported by documents/screen shots etc..After going through your post it appears to me that the man appointed as principle is dictating on his whims ....and I have nothing to say in this regard. I shall like to comment only on the technical aspects related to service regulations. LEAVE IS NOT A MATTER OF RIGHT. Even the CASUAL LEAVE can only be availed subject to the either prior or post-facto approval of the Leave Sanctioning Authority and CASUAL LEAVE is not treated as leave as mentioned in the Leave Regulations. In case of exigencies the Authority may not grant any kind of leave expect the leave usually allowed for treatment or similar kind of purposes. But your Authority may not the appropriate body to deduct the salary for availing CL without prior permission unless and until the same had been ratified by the appropriate body. As I am not fully aware of the structure of your Institution or its functioning so it is very risky for me to suggest something but if you post with relevant documents in future then this Forum may be able to suggest you some suitable measures that are required to be taken from your end. 10.without giving showcause they suspended me
so please help me my way to what i have to do?
1.our school have the affiliation of w.b.b.s.e and w.b.c.h.s.e but they did not follow the rule of the board.
2.the school have no owner(last year the owner thrown out by the MC) it is run by MC which is still did not got approval from board.
3.every time they underestimated every teacher,also some of the MC member have not the desired qualification also which is given in board notice.
4. whenever any teacher ask or request anything to the principal he simply say give in written or say leave the job
5.when i have given in written that what is going on in our school they have suspended me without giving show cause and predecided in a meeting that they should sacked me from the job.
6.every teacher is mentally broke down with the behaviour of MC meber.
7.the environment also be very rough with this environment can effect 1200 approx. students study.
1.when did they suspend you?
2.have they issued any notice to you?
3.have they informed the w.b.b.s.e. council about you?
4.are you getting your salary?
1.they suspend me at 1 st august
